Acceptance of Terms
Agreement to Terms
- •By accessing or using Jawaplum's services, you agree to be bound by these Terms of Service
- •These terms apply to all visitors, users, and clients of our services
- •If you disagree with any part of these terms, you may not access our services
- •We reserve the right to update these terms at any time with notice
- •Continued use after changes constitutes acceptance of new terms

- •Digital marketing and SEO services
- •UI/UX design and consultation
- •E-commerce development and integration
- •Ongoing maintenance and support services

Client Responsibilities
Content and Materials
- •Provide accurate and complete project requirements
- •Supply all necessary content, images, and materials in a timely manner
- •Ensure you have rights to all provided content and materials
- •Review and approve deliverables within agreed timeframes
- •Maintain backup copies of all provided materials
Communication and Feedback
- •Respond to communications within 48 hours during business days
- •Provide clear and constructive feedback on deliverables
- •Designate a primary point of contact for project communications
- •Attend scheduled meetings and calls as agreed
- •Notify us promptly of any changes in requirements or timeline
Technical Requirements
- •Provide necessary access to hosting accounts and domains
- •Ensure hosting environment meets technical requirements
- •Maintain current backups of existing websites before modifications
- •Test deliverables in your environment and report issues promptly
- •Keep login credentials secure and update them regularly

Payment Terms and Billing
Payment Structure
- •30% deposit required to begin work on new projects
- •40% due at agreed project milestones
- •30% final payment due upon project completion
- •Monthly retainer payments due on the 1st of each month
- •All payments processed in Pakistani Rupees (PKR) unless otherwise agreed
Payment Methods
- •Bank transfer (preferred method)
- •Online payment platforms (Stripe, PayPal)
- •Cash payments for local clients (by appointment)
- •Cryptocurrency payments (Bitcoin, USDT) upon request
- •Payment plans available for projects over PKR 500,000
Late Payments and Fees
- •Invoices are due within 15 days of issue date
- •Late payment fee of 2% per month on overdue amounts
- •Work may be suspended for payments overdue by 30+ days
- •Collection costs and legal fees may be added to overdue accounts
- •Refund requests must be made within 30 days of payment

- •Project timelines are estimates based on scope and complexity
- •Timelines may be adjusted for scope changes or client delays
- •We commit to transparent communication about any delays
- •Rush projects may incur additional fees (25-50% surcharge)
- •Holiday periods may affect delivery schedules
Delivery Process
- •Deliverables provided through secure file sharing platforms
- •Client testing period of 7 days for major deliverables
- •Minor revisions included in original scope
- •Major changes require separate agreement and billing
- •Final files delivered upon full payment completion
Quality Assurance
- •All code tested across modern browsers and devices
- •Performance optimization included in development process
- •Security best practices implemented in all projects
- •SEO fundamentals included in web development projects
- •Documentation provided for custom functionality

Intellectual Property Rights
Client Ownership
- •Clients own all custom code and designs upon full payment
- •Rights to provided content and materials remain with client
- •Source files and documentation transferred upon project completion
- •Client may modify or enhance delivered work as needed
- •No ongoing licensing fees for custom development work
Jawaplum Rights
- •We retain rights to general methodologies and techniques
- •Third-party tools and frameworks remain under their respective licenses
- •We may showcase completed work in our portfolio (with permission)
- •Pre-existing intellectual property remains our property
- •We reserve the right to create similar solutions for other clients
Third-Party Components
- •Open-source components used under their respective licenses
- •Premium themes/plugins require separate licensing by client
- •Stock photos and assets require appropriate licensing
- •Client responsible for ongoing license compliance
- •We provide guidance on licensing requirements

Warranties and Limitations
Service Warranties
- •90-day warranty on custom development work for bugs and defects
- •Warranty covers functionality as specified in original requirements
- •Warranty does not cover issues caused by third-party modifications
- •Browser compatibility guaranteed for current and previous major versions
- •Performance guarantees based on agreed specifications and hosting environment
Limitation of Liability
- •Our liability limited to the total amount paid for services
- •We are not liable for indirect, consequential, or punitive damages
- •Client responsible for maintaining backups and data security
- •We are not liable for third-party service outages or failures
- •Force majeure events may affect service delivery without liability
Disclaimer
- •Services provided 'as is' without additional warranties
- •We do not guarantee specific business outcomes or results
- •Client responsible for compliance with applicable laws and regulations
- •We are not liable for content accuracy or legal compliance
- •Third-party integrations subject to their terms and availability

Termination and Cancellation
Project Termination
- •Either party may terminate with 30 days written notice
- •Client pays for all work completed up to termination date
- •Deliverables provided for paid work upon termination
- •Refunds calculated based on work completed and expenses incurred
- •Termination fees may apply for projects less than 50% complete
Retainer Cancellation
- •Monthly retainers may be cancelled with 30 days notice
- •Unused retainer hours do not roll over to following month
- •Final invoice issued for any work completed in final month
- •Access to support services ends at retainer termination
- •Transition assistance provided for ongoing projects
Breach of Terms
- •Immediate termination for material breach of terms
- •Non-payment constitutes material breach after 30 days
- •Violation of intellectual property rights grounds for termination
- •Abusive or threatening behavior grounds for immediate termination
- •Legal action may be pursued for serious breaches
